TERMS AND CONDITIONS

 

1. RESPONSIBILITY OF CLIENT:

- The client is responsible for the safekeeping and condition of the equipment from the point of hire until the point of return. This is inclusive of dry hires, deliveries, pick-ups, and wet hires.


- Equipment must be returned in the same condition as it is received. Cleaning fees of up to $50 per item may be applied at the digression of Enlightened Productions if the equipment is returned unclean.


- Service fees of $5 per cable may be applied if cables are returned tangled/unclean.


- Please make sure you never leave your hired equipment unattended. If the equipment is damaged or the equipment is not returned as a result of loss/misplacement/theft, the client is responsible for its repair/replacement at recommended retail price (RRP). 


- Photo identification of the client is required before the equipment is released. Approved photo identification is a front and back image of a driver's license, passport, or keypass. Images will be deleted from our system upon the return of the hired equipment.



2. HIRE PICK-UP/RETURN PERIOD:

- All item pricing for hire is for a 24-hour hire period unless an alternative hire period has been arranged with Enlightened Productions.


- Invoices must be paid in full prior to equipment being released unless another agreement has been made in writing with Enlightened Productions.


- Enlightened Productions reserves the right to allow extended hire periods at no extra charge where we see fit, we also reserve the right to book equipment with your knowledge to be due back at a certain time on the day of return/collection.


- All hires must be returned/collected when agreed to.


- Any hire which is not returned by the agreed time will incur extra hire charges per day of the daily hire amount for each/every item(s) not returned. 



3. USE OF DISCOUNTS

- All discounts are applicable to equipment only, no delivery or labour Services are included in any Discount Code. 




4. EQUIPMENT ISSUES

- We strongly encourage all customers to set up and test equipment as soon as possible. If there are issues in set-up/operation, we advise you to contact us for troubleshooting assistance.


- Damaged equipment due to liquids inside electronic equipment may incur additional service fees of up to $250. Treat equipment with respect and avoid having liquids placed near electronic equipment at all times.


- If you experience a suspected pre-existing fault with our equipment, we encourage you to contact us as soon as possible to try and diagnose the issue with you. In extreme cases, we will make a note to inspect the equipment upon return and can organise a discount/credit/refund for the item/s of equipment that demonstrates a pre-existing fault. 


- We strongly encourage you to contact us if you believe you have caused damage to any of the equipment during the process of hiring as this will allow us to perform efficient fault diagnosis and may reduce diagnosis charges.


- In an installation sale, the client (or client-chosen representative) will be shown how the system is performing and a sign-off that the system is performing as described will be required.

 




5. DELIVERY TERMS

- Bookings for delivery must be made 14 days in advance of the event date and a deposit may be requested to enable us to schedule the delivery. We can not guarantee delivery availability later than this time frame and there may be extra charges to find a suitable transport option within this time frame.


- Invoices must be paid in full prior to equipment being released unless another agreement has been made in writing with Enlightened Productions.


- Bookings are subject to stock availability.


- Larger bookings and/or larger/heavier items will require additional delivery fees and may require additional labour fees. Additional delivery charges are per vehicle required and include vehicle rate + fee per kilometer measured from “Melbourne, Victoria, Australia” to the event location using the quickest route without tolls using google maps with the arrival time set to bump-in time.


- If vehicles are required for multiple days, the vehicle rate will be multiplied per day required and any extra distance will be added.






6. CANCELLATIONS, CREDITS, REFUNDS, AND FEES

- If the equipment requested is unavailable (and a suitable substitute cannot be recommended) you will be contacted, and a refund or credit note will be issued equal to the value of the affected items or to the full value of the booking.


- Our Refund Policy is strictly based on the time a booking cancellation is made. If a booking is canceled:

a. Within 1-7 days of the event date (or scheduled delivery date): no refund or credit will be issued.

b. Within 8-14 days of the event date (or scheduled delivery date): a 50% credit note will be issued or a refund can be issued less the deposit amount or amount due to cross-hired equipment.

c. Outside 14 days from the event date (or scheduled delivery date): a 100% credit or refund can be issued.

d. On events over $5,000 (before any discounts) or where equipment has to be cross-hired, an additional 7 days will be added to sections b and c above. (Section b. 8-21 days, section c. 21 days)


- If a booking is canceled on the day as a result of the client not being able to satisfy the deposit and/or Identification Requirements, no refund or credit note will be issued.


- If the venue does not allow certain pieces of equipment to be used or does not have the facilities to use certain equipment or it is not safe to use certain equipment in a situation at the discretion of Enlightened Productions (for example, not enough available power, insufficient load ratings or unsafe rigging), refunds will not be given on those items.


- Invoices are required to be paid in full before equipment is released to the client.


- Invoices that are not paid in full 2 weeks after the due date will incur an additional 10% late fee on the outstanding amount per week (excluding additional late fees) until the outstanding amount is paid in full unless another agreement has been made in writing.


- In the event that there is no response to contact regarding outstanding amounts for 1 month from invoice date or latest reminder and/or any outstanding amount has not been paid after 3 months, legal action will be taken and all related costs will be invoiced to the client.


- In an installation or sale, all equipment remains the property of Enlightened Productions until the invoice is paid in full. We reserve the right to repossess all equipment in unpaid invoices and the client will be invoiced for all related costs.


- If a rendering or design work is required, a design fee will be charged. This is to be paid before any design work can be done and before any detailed quotes, quote breakdowns, invoices, or plans are given to the client. The design fee is non-refundable but all other terms and conditions apply to it.





By accepting the quote or invoice from Enlightened Productions or by signing below, the client accepts these terms and conditions.
